Terms of sale

GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale are entered into, on the one hand, by the micro-enterprise of Lucile Diacono (hereinafter "Paesina"), whose registered office is located at 47 Rue Vivienne, 75002 Paris, France, registered under SIRET number 80740209400047, and on the other hand, by any natural or legal person wishing to make a purchase via the shop's website (hereinafter "the Buyer").

1. Purpose

These Terms of Sale define the contractual relationship between Paesina and the Buyer, as well as the conditions applicable to any purchase made on the online shop. Placing an order implies the Buyer's unreserved acceptance of these terms.

2. Products and personalisation

The products offered are handcrafted ceramic creations.

  • Made to order: With the exception of pieces available immediately (in stock), the products are made exclusively at the Buyer's request, which the Buyer acknowledges.
  • Characteristics: The photographs are as accurate as possible but cannot guarantee a perfect likeness to the product delivered (handcrafted appearance, glaze nuances, differences in marbling patterns), which the Buyer accepts.

3. Prices and payment

  • Prices: Prices are stated in euros (€) excluding VAT, in accordance with Article 293 B of the French General Tax Code (VAT not applicable). Paesina reserves the right to change its prices at any time.
  • Payment: Payment is made in full at the time of ordering by bank card, PayPal or Apple Pay. The order is only confirmed once the payment has been approved by the bank.

4. Orders and cancellation

Given that the handcrafted production process begins as soon as the order is placed:

  • Any confirmed order is considered firm and final, subject to the right of withdrawal applicable to in-stock pieces (section 5).
  • No cancellation is accepted once payment has been made for pieces made to order or personalised.

5. Right of withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, the Buyer has 14 days from receipt of their order to exercise their right of withdrawal, without having to give any reason, for pieces available immediately (in stock). To exercise it, the Buyer simply needs to contact us at paesina.ceramics@gmail.com before this period expires. Return and refund terms are set out in the Refund Policy.

However, in accordance with Article L221-28 3° of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of goods made to the consumer's specifications or clearly personalised. Pieces made to order or personalised are therefore excluded from the right of withdrawal.

6. Delivery

Delivery terms (lead times of 6 to 8 weeks, carriers, weight-based costs) are governed by the Shipping Policy available on the website, which forms an integral part of these Terms of Sale.

7. Legal guarantees

The Buyer benefits from the legal guarantee of conformity (Articles L. 217-4 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code). In the event of non-conformity, the product may be returned to the Publisher, who will take it back or exchange it.

8. Consumer mediation

In accordance with the provisions of the French Consumer Code concerning “the consumer dispute mediation process”, after contacting us and in the absence of a satisfactory response, you may use a consumer mediation procedure free of charge with:
